These terms and conditions set forth the basic rules which apply to Autopart's services, may change in the future upon notice published on-line or otherwise provided by Autopart, and every user agrees to comply with them. If any of the terms or conditions of sale, services, system or pricing is unacceptable to any user, the user may terminate its account or stop using the services and the system.

* Changes to Service

The services provided by Autopart are expected to change from time to time. Autopart reserves the right to change any service offered or the features of any service offered or its system without notice, including changes to access and use procedures.

*Commercial Products and Warranty

All Commercial products are sold only under the manufacturers original warranty and no other warranty is available or applicable. Autopart.com is the distributor, not the maker of or otherwise responsible for any of such products.

* Products sold are warranted to be free of defect in workmanship or material for a period of 1 year/12 000 miles from date of purchase, unless the warranty period is different as specified in the corresponding online specific part catalog. This warranty is available by the corresponsing manufacturer (maker of part) only, not by autopart.com. The remedy for breach of this warranty is limited to the free exchange of the product(s) shown to the manufacturer's satisfaction to be defective. Labor costs are not covered. Liability for neglect, misuse, special, incidental, direct, indirect and consequential damages is specifically disclaimed.

* No Warranty; Limitation of Liability

Use of Autopart's services and system and the internet in general is at user's sole risk. Autopart does not warrant that its services and system will be uninterrupted or error free; nor does Autopart make any warranty as to the results or information obtained from use of its service or system or the internet in general. Autopart's services and system are provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied, including implied warranties of merchantability or fitness for a particular purpose, all of which warranties are hereby expressly disclaimed except to the extent any warranty cannot be disclaimed under applicable law. Under no circumstances shall Autopart be liable for any indirect, incidental, special or consequential damages, including, without limitation, loss of profits. The maximum liability of autopart to any user for any and all loss, claim, damage or liability of any kind, including due to autopart's negligence, shall be limited to the amount paid by the user to autopart during the one month period preceding the claim.

* General Shipping Policies

  1. Most orders are shipped normally the next business day. That also means that orders placed on friday will be shipped the next monday.
  2. All orders are shipped either UPS or FEDEX ground or US priority mail unless you notify us otherwise. We do ship priority mail to any valid USA address incl those outside continental USA.
  3. Autopart.com ships from different warehouses. All shipping charges are calculated based on the weight and/or dimension of the boxed part going to the recepients address. Different shipping rules apply depending on the type of part, where it is coming from and where it is going to. We ship from the closest warehouse location that has the part in stock to minimize shipping charges and delivery time.
  4. Note that autopart.com may charge additional shipping if the actual shipping cost is much more than the quoted shipping estimate.
  5. Most orders are received within 3 - 5 business days of ordering.
  6. Note: APO, HI, PR, etc. orders that are outside the continental USA are shipped US postal service priority insured mail. The actual shipping cost will be billed or added in this case. If the parts are too big to be shipped by mail, you will be contacted first for the delivery options.
  7. All International orders will be charged actual shipping cost + $10 document fee. Local Custom's Duties and/or taxes are the sole responsibility of the receiver.
  8. Autopart.com charges sales tax in the state of Massachusetts only. There are no other hidden charges.
  9. All orders are shipped with a tracking number. UPS or the US postal service does not require signature when they deliver the parts. You agree that the tracking number is sufficient proof that we have shipped you the part. Delivery is the responsibility of the carrier only. If you require a signature or insurance, you must specifically ask for it in the free text field when you enter your billing and delivery information. If there are any problems in transit time autopart.com will assist you, the customer, in all possible ways to solve the problem or obtain a remedy from the shipping company. The ultimate responsibility to resolve shipping problems though lies within you. We make all necessary precautions to ship the part safely. Autopart.com is not liable for problems during transit time!
  10. Occasionally a part may not be available for immediate shipping. The customer will be notified and order canceled unless the customer requests the part to be backordered and shipped when available.
  11. When you are returning a core (the old part in case of a remanufactured part) the return postage is your responsibility.
  12. Every effort is made to insure your order is accurately and properly packaged. If for any reason there is anything missing , please contact us immediately. It is the responsibility of the carrier for delivery of the merchandise in good condition. Please, inspect the contents of the package for damage prior to signing the delivery receipt. Failure to accurately inspect or inventory the contents may result in the carrier refusing the damage claim. If you receive an opened or damaged package, have the courier write “damaged” on the delivery sheet. Any visible (external evidence of) damage or loss must be noted on the freight bill or delivery receipt and signed by the carrier’s agent. Failure to accurately describe external damage or loss may result in the carrier’s refusing to honor the damage claim. Concealed damage (damage that does not become apparent until the merchandise becomes unpacked) may occur due to rough handling even though the package has no visible damage. If the damage is not noticed until the box is unpacked, notify the carrier immediately by phone or in writing. Do not throw away the packing material or the box. You must file your claim within 15 days of the original delivery date. Autopart.com is not responsible for damage received in transit.
  13. We make every reasonable effort to ship you the correct certified part and transfer maximum cost savings to you , the customer. The maximum liability that autopart.com may incur is the actual amount charged for parts or services rendered.

* Return Policy

  1. If you want to return a part you must contact us first to obtain an RMA number by sending us an email with description of the problem
    Absolutely no returns on new parts without an RMA number or more than 30 days of receipt of parts. Cores (the old part in the case of a remanufactured part) should be returned within 90 days. No RMA is needed in this case. The return address is sent in the Order Confirmation email.
  2. If you mail the return part directly to the place where it came from without an RMA number you WILL NOT receive a refund!
  3. All new returns or cancellations are subject to 25% restocking charge except if you have received a wrong part due to autopart.com's error.
  4. A wrong part can always be exchanged with the correct one at no charge. However if you claim the part is wrong but you do not wish to exchange it, the 25% restocking fee applies.
  5. Special ordered parts are NON returnable.
  6. Shipping charges are NON refundable.
  7. No refunds on electrical parts if they were "tried" or "installed". All electrical parts must be returned in a "Sealed Box" condition only to get a refund.
  8. No returns accepted after 30 days of receipt of parts. All new returns must be postmarked no later than the 30th day after receipt of shipment to be elgible for a refund. No exceptions on new returns! Cores must be returned within 90 days to get the core deposit refunded.
  9. When you are returning a core (the old part in case of a remanufactured part) the return postage is your responsibility.
  10. Autopart.com does not issue return shipping labels. It is the responsibility of the customer to return the part to Autopart.com's location as identified above.

* Indemnity

The user agrees to indemnify and hold harmless Autopart, its directors, officers, shareholders, agents, employees and its other users from any and all claims, liabilities, damages, or expenses, including attorney fees, arising out of or resulting from any and all use of user's account whether or not authorized.

* Confidentiality and Privacy

Electronic mail and other transmissions passing over the Internet and through Autopart's system are not confidential, unless entering special secure areas, specifically designated as so. Accordingly, Autopart cannot guarantee privacy of information flow on normal unsecure links, such as normal e-mail.
The server of autopart.com collects the IP address of the user that is viewing the page in a log file. This file is viewed periodically to check for unauthorized activity, then deleted after 6 months. This is inherent in all internet servers. Autopart.com does not use "cookies" except for session only cookies when you use the shopping cart to add parts and enter billing information. That cookie is deleted after you close your web browser. Thus autopart.com does not keep track of users' information.
All orders' information is kept strictly confidential. Autopart.com does not release to third parties any user's information, except if required by an authorized governmental agency or officials.

* Interpretation

These terms and conditions supersede all other written and oral communications or agreements with regard to the subject matter. A waiver or modification of these terms and conditions shall only be effective if in a writing signed by an authorized officer of Autopart. These terms and conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts without regard to choice of law principles.

The Information and products provided by Autopart are taken from sources which we deem reliable. we do not represent that it is accurate or complete,and should not be relied on as such. Such information is furnished as a matter of service only and is not deemed an offer to sell or solicitation on any offer to buy a product or information mentioned herein.

Miscellaneous Notes:

* Autopart.com sells replacement parts for vehicles made for the North American Market Specifications. If your vehicle was not intended to be sold originally in the USA we cannot guarantee the parts will always fit.

* Autopart.com is not responsible for occasional typographic errors.

* All prices in the online catalogs are subject to change without notice.

* We reserve the right to substitute like brand with same quality for any item listed in order to expedite shipping.

" We reserve the right to cancel any order at our own discretion without reason to customer.

* If the part is not available or the price has adversely changed you will be contacted prior to shipping to clear any potential problems.

* If you do not agree with any of the terms set forth please do not use the services we offer.
